Державна підтримка розвитку антимонопольних саморегулюючих організацій

Abstract

У роботі розглянуто основи функціонування саморегулюючих організацій та причини їх виникнення на ринку. Спираючись на ступінь впливу саморегулюючих організацій на ринок, визначено види співпраці органів державної влади з саморегулюючими організаціями. Розглянуто переваги функціонування саморегулюючих організацій у антимонопольному регулюванні над державними антимонопольними органами, а також певні обмеження функціонування таких організацій на ринку. Базуючись на повноваженнях саморегулюючих організацій, визначено основні інструменти, якими саморегулюючі організації можуть впливати на ринок для покращання його функціонування. Багатофункціональність саморегулюючих організацій та переваги їх функціонування на ринку, обумовлюють доцільність державної підтримки та розвитку таких організацій. The paper considers the basic of self-regulatory organizations and causes of their functioning in the market. Different types of cooperation between state authorities and self-regulatory organizations are based on the degree in influence of the self-regulating organizations on the market. The paper considers advantages of self-regulatory organizations functioning in the antitrust regulation over state antitrust authorities as well as the limitations of functioning of such organizations in the market. Instruments of self-regulatory organizations that can influence the market to improve its functioning were determined relying on the authority of self-regulatory authorities. The expediency of state support and development of self-regulating organizations in antitrust is based on the versatility and advantages of the self-regulatory organization of the functioning in the market.
