Напрями вдосконалення організаційних засад притягнення до дисциплінарної відповідальності працівників державного бюро розслідувань

Abstract

У статті на основі аналізу наукових поглядів учених та норм чинного законодавства України визначено напрями вдосконалення орга- нізаційних засад притягнення до дисциплінарної відповідальності працівників Державного бюро розслідувань. Наголошено, що до членів дисциплінарної комісії Державного бюро розслідувань мають пред’являтися суворі вимоги як у частині професійної підготовки, так і щодо їхніх морально-етичних та інших особистих характеристик. Особа, яка обирається до даної комісії, повинна чітко розуміти, що і для чого робить, усвідомлювати значення та важливість доручених їй завдань. Особлива увага при цьому має бути приділена членам комісії, яких призначає Рада громадського контролю. Адже відповідність членів дисциплінарної комісії, які є працівниками Державного бюро розслідувань, вимогам щодо психофізичного здоров’я, рівня професійної підготовки, особистих, ділових та моральних якостей перевіряється ще на стадії прийняття осіб на службу до Державного бюро розслідувань. Також необхідно врегу- лювати питання про те, чи повинні члени дисциплінарної комісії Державного бюро розслідувань, що визначаються Радою громадською контролю, бути членами даної ради, або ж можуть залучатися інші особи; чи може член дисциплінарної комісії Державного бюро роз- слідувань, який є представником громадськості, бути Головою цієї комісії. Визначена необхідність у системі органів Державного бюро розслідувань створити постійно діючі дисциплінарні комісії, що має забез- печити більш високий рівень відповідальності її членів до виконуваної роботи, а також дієвіший контроль за якістю роботи даних комісій. Зроблено висновок, що для вирішення зазначених у статті організаційних питань притягнення працівників Державного бюро роз- слідувань до дисциплінарної відповідальності необхідно прийняти відповідне положення про дисциплінарну відповідальність, в якому слід визначити вимоги щодо її формування, закріпити основні аспекти її правового статусу, а також врегулювати засади взаємодії дис- циплінарної комісії з керівником органу. In the article, on the basis of analysis of scientific views of scientists and norms of the current legislation of Ukraine, the directions of improvement of organizational principles of bringing to disciplinary responsibility of employees of the State Bureau of Investigation are determined. It was emphasized that members of the disciplinary commission of the State Bureau of Investigation should be subject to strict requirements both in terms of professional training, as well as their moral, ethical and other personal characteristics. The person elected to this commission must clearly understand what he or she is doing, and be aware of the importance and importance of the tasks entrusted to her. Particular attention should be paid to the members of the commission appointed by the Board of Public Control. After all, the compliance of the members of the disciplinary commission, who are employees of the State Bureau of Investigation, with the requirements on psychophysical health, level of professional training, personal, business and moral qualities, is checked at the stage of admission of persons to the State Bureau of Investigation. It is also necessary to regulate the question of whether members of the disciplinary commission of the State Bureau of Investigation, determined by the Public Control Board, should be members of this board or other persons may be involved; whether a member of the disciplinary commission of the State Bureau of Investigation, who is a member of the public, may be the chairman of that commission. The necessity of establishing a system of permanent disciplinary commissions in the system of bodies of the State Bureau of Investigation, which should ensure a higher level of responsibility of its members for the work performed, as well as more effective control over the quality of the work of these commissions. It has been concluded that in order to resolve the organizational issues of disciplinary liability of employees of the State Bureau of Investigation, it is necessary to adopt an appropriate provision on disciplinary responsibility, which should determine the requirements for its formation, consolidate the main aspects of its legal status, as well as regulate the principles of cooperation of the disciplinary commission organ.
