| Abstract: | Статтю присвячено дослідженню існуючих у науці підходів до визначення поняття земельного спору. Розглянуто його основні відмінності від конфлікту. Підкреслюється відсутність загальноприйнятого визначення земельного спору, при цьому наявні підходи умовно диференціюються за їх змістом на «матеріальні» та «процесуальні». Обґрунтовано, що земельний спір є динамічним явищем і може пройти у своєму розвитку кілька стадій: від вираження розбіжностей сторін із приводу суб’єктивних прав і законних інтересів на землю до винесення й виконання рішення суду. Ключові слова: земельний спір, конфлікт, захист, судовий процес, динаміка земельного конфлікту. |
| Description: | The article is devoted to the study of existing science approaches to the definition of land dispute. Its main differences from the conflict are considered. It emphasizes the absence of a generally accepted definition of a land dispute, while existing approaches are conventionally differentiated by their content on the “material” and “procedural”. It is proved that the land dispute is a dynamic phenomenon, and it may be in its development stages: from the expression of the arguments of the parties concerning the subjective rights and legitimate interests in the land before imposition/execution of court decisions. Key words: land dispute, conflict, protection, judicial process, dynamics of the land dispute. |
