Перспективи запровадження мирної юстиції в України

Abstract

Стаття присвячена проблемам відновлення інституту мирової юстиції в Україні, враховуючи вітчизняний історичний досвід функціонування мирових судів після судової реформи 1864 року в Російській імперії, а також досвіду становлення цього інституту у Російській Федерації в сучасний період. Розглядається поняття «мирова юстиція» та її модель. Досліджуються проекти закону про мирових суддів, концепція закону про мирових суддів, позиції окремих науковців з цього питання. Висловлюється авторське бачення оптимальної моделі мирової юстиції для України.

The аrtісІе dedicated to the problems of the restoration of the lnstitute of Justice of the Реасе in Ukraine, taking into account the historical experience of the functioning of the J.P.s after the judicial reform in 1864 іn the Russian Empire, as well as the experience іn the establishment of the lnstitute of the Russian Federation іn the modern period. There is the definition of «justice of the реасе» and its model. We research the draft law оn J.P.s, the concept of the law оn J.P.s. the positions of individual scientists with the issue. There is the author's point of view with regard to the optimal model of justice of the реасе for Ukraine.
