Міжнародний договір як джерело конституційної модернізації суспільства

Abstract

У статті аналізується поняття міжнародного договору та вплив його на конституційне законодавство. Проаналізовано визначення міжнародного договору, що застосовуються у конституційно-правовій сфері та їх ознаки. Розглянуто процес набрання чинності міжнародним договором в Україні. Порівняно на прикладі конституцій різних держав процес імплементації міжнародних договорів у конституційне законодавство держав. Виділено сучасні доктринальні теорії поєднання міжнародних договорів та внутрішнього права держав.

The агtісІе analyzes the concept of an international treaty and its impact оn constitutional legislation. The definitions of the international treaty that are applied in the constitutional and legal sphere and their signs аrе analyzed. The process of entry into force of an international treaty in Ukraine is considered. The example of the constitutions of different states of the processes of implementing international treaties in the constitutional legislation of states is compared. The modern doctrinal theories of the соггеІаtіоn between international treaties and the internal law of states are singled out.
