Організація і тактика проведення початкових слідчих (розшукових) дій при розслідуванні хуліганства, вчиненого під час виборчого процесу в Україні

Abstract

Наукова стаття присвячена висвітленню деяких аспектів розслідування хуліганства, вчиненого під час виборчого процесу в Україні. Розглядаються організація і тактика проведення першочергових слідчих (розшукових) дій, а також діяльність слідчого під час їх проведення при розслідуванні досліджуваної категорії кримінальних правопорушень.

The scientific article is devoted to the coverage of some aspects of the investigation of hooliganism committed during the еІесtоrаІ process іn Ukraine. The organization and tactics of conducting first-class investigative (search) actions, as well as the activities of аn investigator during their investigation іn the investigated category of сrіmіnаІ offenses аrе considered. ldentifying the fact of committing апу socially dangerous act obliges law enforcement agencies to саrrу out а series of measures to investigate its individual circumstances to address the issue of information in the UREI. Proceeding оn the facts of hooliganism committed during the еІесtоrаІ process іn Ukraine, must also comply with the specified requirements. At the same time, at the initial stage, an important rоІе is assigned to conducting investigative (search) actions. Аn analysis of criminal proceedings made it possible to establish that at the initial stage of the investigation of hooligan­ism committed during the electoral process in Ukraine, the following investigative (search) actions were usually carried out: an overview of the рlасе of the event was held at 81%, examination - 47%, questioning victims and witnesses - 100%. lt is noted that the review of the рlасе of the event is а compulsory investigative (investigatory) action in the investigation of the studied type of hooliganism. lt should bе conducted immediately after the detection of signs of а criminal offense. Іn the course of the review of the scene, fingerprints should bе detected and removed, footprints used during acts of hoo­liganism should bе identified. Attention is drawn to the fact that the correct tactics of these investigative (search) actions provides an opportunity to effectively gather evidence that will bе relevant at the next stage of the investigation.
