The article clarifies the constitutional principles of the veto right of the President of Ukraine, taking into account the changes that were made to the Constitution of Ukraine in the part of the veto right of the President of Ukraine in 2004, and assesses the legal positions of the Constitutional Court of Ukraine regarding the veto right of the President of Ukraine. It is concluded that the veto right is an element of the legislative process itself, while such an element inherently contains the need to ensure the separation of powers and the implementation of the principle of checks and balances. It is proved that the key evolution of approaches to the constitutional regulation of the veto right took place in practice in 2004 by making amendments to the Constitution of Ukraine (concerning the veto regarding laws on amendments to the Constitution of Ukraine, as well as the signing of laws by the Speaker of the Parliament after overcoming the veto). It is substantiated that the veto is a traditional element of the constitutional powers of the president in the constitutional landscape of many countries, ensuring the legitimacy of the legislative process. In Ukraine, the President’s veto right is of a general nature (applies to the law as such) and relative (i.e. with the possibility of overcoming). Moreover, the position of the Constitutional Court of Ukraine on the possibility of exercising the right of veto regarding laws on amendments to the Constitution was quite successfully adjusted in 2004 by amending the Constitution. We believe that the possibility of signing a law to which a veto was applied, but which remains unsigned by the President, which also appeared in 2004, is useful on the one hand. On the other hand, its appearance and practice of application from 2006 to 2009 demonstrated the lack of traditions, serious distrust between the highest bodies of state power. The key positions of the Constitutional Court of Ukraine regarding the right of veto in the decisions of July 7, 1998 No. 11-rp/98, April 16, 2008 No. 6-rp/2008 and July 7, 2009 No. 17-rp/2009 are described. It is concluded that the form of the veto as an act of the President still remains debatable. Not being his decree or order, the veto itself, as well as the President’s proposals for the law, do not fit into the logic of Part 3 of Article 106 of the Constitution of Ukraine. That is why their registration as a decree would look more justified.
