The article presents a comparative legal analysis of the application of the principle of separation of powers into legislative, executive and judicial in the Constitution of Ukraine of 1918 and the Constitution of Poland of 1921. It is proven that the Constitution of Ukraine of 1918 and the Constitution of Poland of 1921 have a number of common features, since both constitutions were based on the ideas of the modern European constitutionalism of the early 20th century. The Ukrainian and Polish constitutions were developed by social democrats and were adopted with the aim of increasing the efficiency of the state mechanism in the conditions of military aggression by Bolshevik Russia. Common features of these constitutions were the consolidation of state sovereignty and territorial integrity, human rights. A characteristic feature of the Constitution of Ukraine of 1918 and the Constitution of Poland of 1921 was the introduction of democracy, parliamentarism, the principle of separation of powers, and a system of checks and balances. But the system of checks and balances in the 1918 Constitution of Ukraine had a number of shortcomings. The legislative, executive, and judicial branches were not independent and equal. The overwhelming majority of powers were concentrated in the hands of parliament, which reduced the effectiveness of the government. However, despite its shortcomings and the fact that the Constitution of Ukraine of 1918 did not enter into force, it was of great importance for the development of national constitutionalism, democracy, and parliamentarism. A more balanced system of checks and balances was provided for by the Polish Constitution of 1921. The state authorities of the parliamentary-presidential republic of Poland had an equal and autonomous status in relation to each other. None of the state authorities could appropriate the powers of another body. The mechanism of the system of checks and balances operated thanks to parliamentary bicameralism, the formation of the government by the President and the Sejm, the participation of the President in the activities of the government, mutual control and mutual responsibility of the legislative and executive bodies. This mechanism was intended to prevent the usurpation of power by a single body or individual and to ensure a high level of efficiency in public administration. However, in practice, the constitutional provisions on the separation of powers and the system of checks and balances did not prevent the establishment of an anti-democratic political regime in Poland in 1926.
