Міжнародно-правові засоби забезпечення соціальних стандартів в сфері прав людини

Abstract

В статті розглядаються особливості правової регламентації міжнародно-правових засобів забезпечення соціальних стандартів в сфері прав людини. Висловлена думка, що універсалізація міжнародних стандартів з прав людини та їх трансформація в національному праві, характеризує сучасний етап позитивного процесу розвитку міжнародного співробітництва в сфері прав людини. З’ясовано, що до міжнародно-правових засобів, призначених для забезпечення і захисту основних прав людини відносять міжнародно-правові акти, міжнародні органи по спостереженню, контролю за дотриманням основних прав людини та по захисту цих прав. В процесі дослідження проаналізовано міжнародні процедури та механізми у сфері забезпечення прав людини. Констатовано, що міжнародні процедури – це порядок та методи вивчення інформації про порушення прав людини та реагування на результати такого вивчення, а контрольні механізми являють собою певні організаційні структури. Особливе місце серед міжнародно-правових засобів, призначених для забезпечення і захисту основних прав людини займає контрольний механізм ООН. Він створений з метою сприяння імплементації розроблених та схвалених Генеральною Асамблеєю ООН універсальних міжнародних актів у сфері забезпечення основних права і свобод людини. Зазначено, що міжнародні процедури є найпоширенішим засобом забезпечення зобов’язань у сфері прав людини. Найбільш типовими серед них є розгляд компетентними органами, передбаченими міжнародними договорами у сфері прав людини, доповідей держав про виконання ними своїх зобов’язань, а також розгляд компетентними органами, передбаченими міжнародними договорами у сфері прав людини скарг, петицій, звернень окремих груп порушення їх прав.На основі аналізу наукових точок зору та законодавства, автори приходять до висновку, що суть міжнародно-правових засобів забезпечення соціальних стандартів у сфері прав людини полягає в створенні й реалізації системи міжнародних норм, механізмів та інституцій, що гарантують дотримання, захист і розвиток соціальних прав людини. The article examines the features of the legal regulation of international legal means of ensuring social standards in the field of human rights. The opinion is expressed that the universalization of international human rights standards and their transformation in national law characterizes the current stage of the positive process of development of international cooperation in the field of human rights.It was found that international legal means intended for ensuring and protecting fundamental human rights include international legal acts, international bodies for monitoring, controlling compliance with fundamental human rights and for protecting these rights. In the process of the study, international procedures and mechanisms in the field of ensuring human rights were analyzed.It was stated that international procedures are the procedure and methods for studying information about human rights violations and responding to the results of such study, and control mechanisms are certain organizational structures. A special place among international legal means intended for ensuring and protecting fundamental human rights is occupied by the UN control mechanism. It was created to facilitate the implementation of universal international instruments developed and approved by the UN General Assembly in the field of ensuring fundamental human rights and freedoms.It is noted that international procedures are the most common means of ensuring obligations in the field of human rights. The most typical among them are the consideration by competent bodies provided for by international treaties in the field of human rights of reports of states on their fulfillment of their obligations, as well as the consideration by competent bodies provided for by international treaties in the field of human rights of complaints, petitions, appeals of individual groups about violations of their rights.Based on the analysis of scientific points of view and legislation, the authors conclude that the essence of international legal instruments for ensuring social standards in the field of human rights is the creation and implementation of a system of international norms, mechanisms and institutions that guarantee the observance, protection and development of social human rights.
