СУБ’ЄКТИ КОНСТИТУЦІЙНИХ ОБОВ’ЯЗКІВ УКРАЇНСЬКОЇ ДЕРЖАВИ

Abstract

Статтю присвячено проблемі визначення кола суб’єктів конституційних обов’язків держави, а також з’ясуванню правової природи держави як суб’єкта конституційних правовідносин. Сформульовано поняття «правовий статус держави». Встановлено, що держава є «соціальною організацією», а не «юридичною особою». Окреслено коло суб’єктів конституційних обов’язків Української держави: Верховна Рада України, Кабінет Міністрів України, Президент України, судові органи, контрольно-наглядові органи, правоохоронні органи, місцеві органи публічної влади.The article is devoted to the problem of determining the circle of subjects of constitutional duties of the state, as well as clarification of the legal nature of the state as a subject of constitutional legal relations. The concept of legal status of the state is formulated. It is established that the state is a «social organizatio», not a «legal entity». The circle of subjects of constitutional duties of the Ukrainian state is outlined: the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the President of Ukraine, judicial bodies, control and supervisory bodies, law enforcement bodies, local authorities of public authority
