The article analyzes the issues of the exercise of the right to a fair trial, the protection and access to justice in the light of the case law of the European Court of Human Rights, the decisions of the Constitutional Court of Ukraine, the provisions of national Ukrainian law. In particular, was studied in detail the issue of whether a concluded arbitration agreement on the transfer of international commercial disputes for consideration and resolution to international commercial arbitration constitutes the restriction of the constitutional rights of participants in civil transactions. As it is known, such an agreement has the legal consequence of excluding the disputes envisaged by the agreement from the jurisdiction of state courts, and therefore, at first glance, there are grounds to conclude that the right to a defense is restricted. Investigation of the above issue is extremely important in the light of law implementation in the process of dispute resolution and international commercial arbitration, and directly affects the finality and binding nature of the decision. In addition, the article analyzes the question of whether international commercial arbitration as a type of arbitration court, that seeks to resolve international commercial disputes, can be understood as a court within the meaning of Art. 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, that is, whether such a “court” can exercise the functions of law implementation and whether the acts rendered as a result of such implementation are binding on the parties, since it is in this case that one can speak of the exercise of the right of defense and the exercise of the right to a fair trial. On this basis, the author concludes that the conclusion of the arbitration agreement in the light of the practice of the ECtHR, the Constitutional Court of Ukraine and the provisions of international treaties of Ukraine does not violate the rights of the parties to such agreement. Similarly, the conclusion of such an agreement cannot be interpreted as an unjustified restriction on the right to a defense in a state court. Thus, by voluntarily concluding an arbitration agreement, a person or company by their own will limits the ability to resolve disputes arising from civil relations in state courts, but the right to defense and access to court is not limited, since in this case the dispute is considered by competent (authorized by the state for the resolution of relevant disputes in accordance with the law) arbitration court. Also, the person is provided with the mechanism of control over the rendered decision and the possibility of forcibly bringing the decision of such court (arbitration) to execution using the powers of state bodies of the executive service.
