ПОНЯТТЯ ТА ЗМІСТ КОНФЛІКТНОЇ КОМУНІКАЦІЇ СТОРІН У СУДОВОМУ ПРОЦЕСІ

Abstract

У статті звернуто увагу до термінопоняття «конфліктна комунікація», яке не є достатньо дослідженим у площині його функціонування в галузевому вимірі, а саме – у судовому процесі, учасниками якого стають непримиренні сторони. Взяті до уваги найновіші напрацювання в цій сфері, зокрема в галузі комунікативістики та юридичної психології, напрями яких потребують свого сучасного переосмислення. Звернуто увагу на методологічне спрямування аналізу конфліктної комунікації сторін у судовому процесі, що стосується не лише суто теоретичних засад дослідження, але й праксеологічних основ.The article focuses on the terminology of “conflict communication”, which is not sufficiently investigated in the field of its functioning in the sectoral dimension, namely, in the judicial process, whose participants become irreconcilable parties. Taking into account the latest developments in this field, including in the field of communicative and legal psychology, whose directions require their modern rethinking. The attention is paid to the methodological orientation of the analysis of conflictual communication of the parties in the court process, which concerns not only the purely theoretical principles of the research, but also its praxeological foundations.
