Підходи до розуміння легітимності влади в історії політичних і правових учень

Abstract

У статті проаналізовано політико-правові погляди представників провідних філософських, політичних і правових шкіл на питання легітимності влади. Висвітлено процес розвитку й становлення поглядів на легітимність влади, починаючи з античних часів і закінчуючи сучасною політико-правовою думкою. Автор робить висновок, що останнє десятиліття ХХ ст. пройшло під знаком вивчення досвіду за рубіжних держав у контексті проблематики легітимності та формування загальнонаукових та філософських підходів щодо її дослідження. Лише наприкінці 90-х рр. ХХ ст. та протягом перших років ХХІ ст. дослідження легітимності влади на пострадянському просторі стало невід’ємною складовою юридичної науки та суміжних із нею наукових напрямів. The article analyzes political and legal views of the representatives of leading philosophical, political and legal schools on issues of legitimacy. It studies the process of development and formation of views on the legitimacy of power from ancient times to modern political and legal thought. The author concludes that the last decade of the twentieth century was marked by studying the experience of foreign countries in the context of the issues of legitimacy and the formation of scientific and philosophical approaches to its study. Only in the late 90s of the twentieth century and the first years of the XXI century the study of legitimacy in the post-soviet countries became an integral part of legal science and related to it scientific fields.
