ПРАКТИКА МЕДІАЦІЇ ЗА ЗАКОНОДАВСТВОМ ЗАРУБІЖНИХ КРАЇН ЯК СПОСІБ ЗАХИСТУ ПРАВ НА ЗЕМЛЮ

Abstract

Стаття присвячена розгляду медіації в закордонних країнах як способу захисту прав на землю. Досліджуються різні погляди сучасних вітчизняних та іноземних представників науки на визначення поняття «медіація», а також розроблено авторське визначення цього поняття. Проведено аналіз практики застосування медіації в США, Німеччині, Білорусі, Казахстані та інших країнах.The article is devoted to the consideration of mediation in foreign countries, as a way of protecting the rights to land. Different views of contemporary domestic and foreign representatives of science on the definition of the term “mediation” are explored, as well as the author’s definition of this concept is developed. An analysis of the practice of using mediation in the USA, Germany, Belarus, Kazakhstan and other countries has been conducted.
