Моделі місцевого самоврядування в Англії та Іспанії: порівняльний аспект

Abstract

У вітчизняній муніципальній науці сформувалися тези про існування декількох основних муніципальних систем у світі. Зокрема, англо-саксонська, романо-германська (континетальна) та іберійська. Разом з тим, науковці ще виділяють скандинавську, північно-європейську, південно-європейську, центрально-європейську тощо. При цьому національна муніципальна наука не містить доволі широкого каталогу досліджень організації місцевого самоврядування країн Західної і Південної Європи. В тому числі актуалізації відповідних досліджень по конкретним країнам також бракує. Українська реформа децентралізації і територіальної організації влади навіть в умовах воєнного стану, хоч і повільно, але продовжує свій рух. Окремим стимулом у розвитку муніципальної влади є наш євроігтеграційний вектор. І в цій частині робота рухається чималими темпами. Тому актуальність дослідження особливостей моделей місцевого самоврядування в зарубіжних країнах є як ніколи на часі. Більш того, європейське майбутнє України напряму залежатиме від розвитку територіальної організації публічної влади на місцях. Тому подальша розбудова і удосконалення вітчизняної моделі місцевого самоврядування є одним із першочергових завдань держави. Цим і обумовлена обрана тематика і відповідні країни. В даній статті ми аналізуємо дві системи місцевого самоврядування, в Англії та Іспанії. На прикладі вказаних країн досліджено особливості північноєвропейської і південноєвропейської моделі муніципального управління. В роботі висвітлені історичні аспекти формування місцевої влади на теренах досліджуваних країн. Разом з тим, стаття комплексно характеризує особливості муніципальних систем Англії та Іспанії, в тому числі, використовуючи порівняльну методологію. Окремий фокус в науковому доробку присвячено статусу мера. Зокрема, закцентовано, що в Англії повноваження і роль мера залежить від територіальних особливостей, і в цій країні мер може отримувати мандат як від громади, так і від ради, окрім цього рада може найняти менеджера. В Іспанії ситуація дещо інша і більш однорідна. Мер є однозначним політичним лідером, обирається радою, і має чималу компетенцію.

In domestic municipal science, theses have been formed about the existence of several main municipal systems in the world. In particular, Anglo-Saxon, Romano-Germanic (continental) and Iberian. At the same time, scientists still distinguish Scandinavian, Northern European, Southern European, Central European, etc. At the same time, national municipal science does not contain a sufficiently wide catalog of research on the organization of local self-government in Western and Southern European countries. Including the actualization of relevant research on specific countries is also lacking. The Ukrainian reform of decentralization and territorial organization of power, even under martial law, albeit slowly, continues its movement. A separate stimulus in the development of municipal power is our European integration vector. And in this part, work is moving at a considerable pace. Therefore, the relevance of research on the features of local self-government models in foreign countries is more timely than ever. Moreover, the European future of Ukraine will directly depend on the development of the territorial organization of public authorities at the local level. Therefore, the further development and improvement of the domestic model of local self-government is one of the priority tasks of the state. This is the reason for the chosen topic and the relevant countries. In this article, we analyze two systems of local self-government, in England and Spain. Using the example of these countries, the features of the Northern European and Southern European models of municipal governance are studied. The work highlights the historical aspects of the formation of local government in the territories of the countries under study. At the same time, the article comprehensively characterizes the features of the municipal systems of England and Spain, including using comparative methodology. A separate focus in the scientific work is devoted to the status of the mayor. In particular, it is emphasized that in England the powers and role of the mayor depend on territorial features, and in this country the mayor can receive a mandate from both the community and the council, in addition, the council can hire a manager. In Spain, the situation is somewhat different and more homogeneous. The mayor is a clear political leader, elected by the council, and has considerable authority.
