Захист прав і законних інтересів суб’єктів господарювання від недобросовісної конкуренції

Abstract

Статтю присвячено аналізу особливостей захисту прав та інтересів суб'єктів господарювання від недобросовісної конкуренцї. Автором досліджуються юрисдикційна та неюрисдикційна форма захисту прав учасників конкурентного змагання від недобросовісної конкуренції. Визначається, що провідною формою захисту прав суб'єктів господарювання є адміністративний захист, який здійснюється Антимонопольним комітетом України. Провідною тенденцією захисту прав добросовісних конкурентів є розширення сфери застосування судового захисту та різноманітних способів самозахисту прав учасників конкурентного змагання.This article analyzes the features of the protection of rights and interests of economic entities from unfair competition. The author studies the jurisdictional and non-jurisdictional forms competitive contest participants from unfair competition. Leading form of protection of the rights of economic entities is administrative security, which is implemented bу the Antimonopoly Committee of Ukraine. The main current trend to protect the rights of bоnа fide competition is expanding the scope of judicial protection and different ways of self-defense rights of participants а competitive competition.
