Джерела права: синергетичне бачення

Abstract

У статті, за допомогою синергетичного методу дослідження, розглядається проблема розуміння, виникнення та становлення джерел права. Звертається увага на різноманіття джерел права, різне співвідношення в них організації та самоорганізації. На підставі проведеного аналізу виділено особливості джерел права та запропоновано визначення цього поняття з позицій синергетики.In the article, the problem of understanding, origin and establishment of law sources as well with the help of the synergetic method of research are examined. Attention is paid to the diversity of sources of law, the different ratio of organization and self-organization in them. The peculiarities of law sources on the grounds of the applied analysis are marked and the definition of a law source is proposed from the positions of the synergetics.
