Деякі аспекти проблем третейських судів

Abstract

У статті розкривається розуміння інституту третейського судочинства. Наведено історичні факти виникнення третейських і громадських судів. Обґрунтовуються причини виникнення третейських судів в Україні. Аналізується виконання рішень третейських судів, участь у цьому процесі органів державної влади. Акцентується увага на тому, що примусове виконання рішень третейських судів перебуває поза межами третейського розгляду спорів, є завданням компетентних судів і державної виконавчої служби.In the article the understanding of the arbitration proceedings institute has been revealed. The historical facts of arbitration and public courts emergence have been given. Reasons of arbitration courts in Ukraine emergence have been given grounds. The execution of arbitration courts decisions and participation in this procedure of public authorities have been analyzed. It is given the special attention to the fact that the enforcement execution of the arbitration courts decisions is beyond the limits of arbitration disputes consideration and it is the task of the competent courts and the state executive service.
