Принципи міжнародного гуманітарного права: зміст, еволюція та сучасні виклики застосування

Abstract

Стаття містить характеристику основних принципів міжнародного гуманітарного права, які являють собою нормативну основу регулювання поведінки сторін у збройних конфліктах. Окрема увага приділена питанню історичної еволюції даних принципів. У статті також наявний аналіз взаємозв’язку вказаних принципів із розвитком міжнародного права прав людини та практикою міжнародних судових інституцій і їх впливом на формування сучасних гуманітарних стандартів.Охарактеризовано також сучасні виклики їх реалізації в умовах трансформації характеру збройних конфліктів. Обґрунтовано, що дотримання принципів міжнародного гуманітарного права залишається ключовим чинником легітимності дій сторін конфлікту та показником рівня гуманізації міжнародних відносин. Особливу увагу у статті приділено взаємозв’язку між принципами міжнародного гуманітарного права та нормами міжнародного права прав людини. Зазначений взаємозв’язок забезпечує узгоджене тлумачення обов’язків держав і недержавних учасників конфліктів. У статті також охарактеризовано сучасні виклики застосування принципів міжнародного гуманітарного права у контексті трансформації збройних конфліктів. Проаналізовано також проблеми реалізації даних принципів у практиці їх застосування. Зроблено акцент на тому, що принципи міжнародного гуманітарного права зберігають на сучасному етапі універсальне і першочергове значення, а їх неухильне дотримання є необхідною умовою забезпечення легітимності дій сторін конфлікту, запобігання надмірним стражданням цивільного населення та гуманізації збройних дій. У статті наголошено на важливості посилення механізмів імплементації зазначених принципів у національне законодавство України, особливо в умовах триваючої збройної агресії рф на території нашої держави, триваючою дією правового режиму воєнного стану, а також на потребі удосконалення міжнародного контролю за їх дотриманням, оновленні механізмів імплементації зазначених принципів на національному рівні та посиленні міжнародного контролю за їх дотриманням. Зазначені питання є вкрай актуальними для нашого сьогодення. The article contains a description of the basic principles of international humanitarian law, which constitute the normative basis for regulating the behavior of parties in armed conflicts. Special attention is paid to the issue of the historical evolution of these principles. The article also contains an analysis of the relationship between these principles and the development of international human rights law and the practice of international judicial institutions and their influence on the formation of modern humanitarian standards.The article also describes the current challenges of their implementation in the context of the transformation of the nature of armed conflicts. It is substantiated that compliance with the principles of international humanitarian law remains a key factor in the legitimacy of the actions of the parties to the conflict and an indicator of the level of humanization of international relations.The article pays special attention to the relationship between the principles of international humanitarian law and the norms of international human rights law. This relationship ensures a consistent interpretation of the obligations of states and non-state participants in conflicts.The article also describes the current challenges of applying the principles of international humanitarian law in the context of the transformation of armed conflicts. The problems of implementing these principles in practice are also analyzed.The emphasis is placed on the fact that the principles of international humanitarian law retain universal and primary importance at the present stage, and their strict adherence is a necessary condition for ensuring the legitimacy of the actions of the parties to the conflict, preventing excessive suffering of the civilian population and humanizing armed actions.The article emphasizes the importance of strengthening the mechanisms for implementing these principles in the national legislation of Ukraine, especially in the context of the ongoing armed aggression of the Russian Federation on the territory of our state, the ongoing operation of the legal regime of martial law, as well as the need to improve international control over their observance, update the mechanisms for implementing these principles at the national level and strengthen international control over their observance. These issues are extremely relevant for our present.
