Сутність та особливості забезпечення Службою безпеки України національної безпеки держави як об’єкта адміністративно-правової охорони та захисту

Abstract

Наукова стаття присвячена дослідженню сутності та особливостям забезпечення Службою безпеки України національної безпеки держави як об’єкта адміністративно-правової охорони та захисту. Зазначено, що Служба Безпеки України відіграє ключову роль у здійсненні адміністративно-правової охорони та захисту національної безпеки держави. Окреслено, що сутність діяльності СБУ полягає в системному аналізі, прогнозуванні та ліквідації загроз, що можуть виникнути як на зовнішньому, так і на внутрішньому фронті. Ця діяльність передбачає надання правового та адміністративного реагування на потенційні та актуальні загрози, виявлення та припинення діяльності вороже налаштованих елементів та терористичних угруповань, які можуть викликати загрозу національній безпеці. Доведено, що забезпечення національної безпеки держави є надзвичайно складним завданням, що вимагає великої відповідальності та професіоналізму. Служба Безпеки України відіграє важливу роль у цьому процесі, діючи як ключовий ланка в системі захисту національних інтересів та безпеки держави. Акцентовано, що адміністративна діяльність підрозділів СБУ, зважаючи на особливий характер специфічного державного виду діяльності цієї служби, повинна характеризуватися не лише через призму її завдань та функцій (захисту державного суверенітету, конституційного ладу, територіальної цілісності, економічного, науково-технічного й оборонного потенціалу України, законних інтересів держави та прав громадян), а з огляду на їхнє організаційне забезпечення (видання правових актів управління, здійснення юридично-значущих дій, організації співпраці, взаємодії та адміністративно-договірної діяльності, участі у заходах із забезпечення прав громадян).Підкреслено, що сутність та особливості забезпечення національної безпеки держави Службою безпеки України визначаються комплексом адміністративно-правових заходів та стратегій, спрямованих на захист суверенітету, територіальної цілісності, конституційного ладу, інтересів громадян і стабільності країни.

The scientific article is devoted to the study of the essence and features of ensuring the national security of the state by the Security Service of Ukraine as an object of administrative and legal protection and protection. It is noted that the Security Service of Ukraine plays a key role in the implementation of administrative and legal protection and protection of the state’s national security.It is outlined that the essence of the activity of the SBU consists in the systematic analysis, forecasting and elimination of threats that may arise both on the external and on the internal front. This activity involves providing a legal and administrative response to potential and actual threats, identifying and stopping the activities of hostile elements and terrorist groups that may pose a threat to national security.It has been proven that ensuring the national security of the state is an extremely difficult task that requires great responsibility and professionalism. The Security Service of Ukraine plays an important role in this process, acting as a key link in the system of protecting national interests and state security.It was emphasized that the administrative activity of the units of the SBU, taking into account the special nature of the specific state type of activity of this service, should be characterized not only through the prism of its tasks and functions (protection of state sovereignty, constitutional order, territorial integrity, economic, scientific, technical and defense potential of Ukraine, legitimate interests of the state and the rights of citizens), and with regard to their organizational support (issuance of legal acts of management, implementation of legally significant actions, organization of cooperation, interaction and administrative and contractual activities, participation in measures to ensure the rights of citizens).It is emphasized that the essence and features of ensuring the national security of the state by the Security Service of Ukraine are determined by a complex of administrative and legal measures and strategies aimed at protecting sovereignty, territorial integrity, the constitutional system, the interests of citizens and the stability of the country.
