Діяльність Організації Обʼєднаних Націй щодо протидії ґендерно зумовленим злочинам

Abstract

Стаття присвячена питанню щодо діяльності Організації Об’єднаних Націй у попередженні та викоріненні ґендерно зумовлених злочинів. Вказано, що ґендерне насильство та ґендерно вмотивовані вбивства можуть бути віднесені до категорії злочинів на ґрунті ненависті, мотивовані нетерпимістю до певних груп населення. Зазначено, що важливий внесок у сфері протидії ґендерно зумотивованим злочинам було зроблено Генеральною Асамблеєю, Генеральним секретарем, Управлінням ООН з наркотиків і злочинності, Комітетом з ліквідації дискримінації щодо жінок, Спеціальним доповідачем з питань насильства щодо жінок і дівчат, його причин і наслідків та іншими органами, установами і структурами Організації. Зокрема, ГА ООН прийняла низку резолюцій у цій сфері, важливе значення серед яких має резолюція 68/191, в якій було викладено рекомендації державам-членам та органам, інституціям й установам ООН щодо заходів проти ґендерно вмотивованих вбивств жінок і дівчаток. На виконання означеної рекомендації було скликано нараду міжурядової групи експертів відкритого складу, в ході якої було розглянуто перспективні види практики і сформульовано низку практичних рекомендацій щодо шляхів і засобів підвищення ефективності зусиль із запобігання та розслідування ґендерно вмотивованих убивств. Вказано, що з 2019 року УНЗ ООН здійснює Глобальну програму з посилення запобігання злочинності та реагування кримінального правосуддя на насильство щодо жінок, надаючи конкретні рішення, що доповнюють наявні спільні програми ООН та країнові проєкти. Зазначено, що важливу роль у протидії ґендерно вмотивованим злочинам було зроблено Комітетом з ліквідації дискримінації щодо жінок. Зокрема, у своїх заключних зауваженнях щодо періодичних доповідей держава-учасниць і в контексті відповідних подальших процедур Комітет незмінно засуджує ґендерне насильство. Крім того, Комітет надає розʼяснення стандартів, що стосуються діяльності з викорінення такого насильства, і повʼязані з цим зобовʼязання держав-учасниць. Акцентовано на діяльності Спеціального доповідача з питань насильства щодо жінок і дівчат, його причин і наслідків у цій сфері.

The article is dedicated to the issue of the United Nations activities in preventing and eradicating gender-based crimes. It is indicated that gender-based violence and gender-motivated killings can be classified as hate crimes motivated by intolerance towards certain groups of the population. It is noted that an important contribution to combating gender-based crimes was made by the General Assembly, the Secretary-General, the UN Office on Drugs and Crime, the Committee on the Elimination of Discrimination against Women, the Special Rapporteur on violence against women and girls, its causes and consequences, and other bodies, institutions and structures of the Organization. In particular, the UN General Assembly has adopted a number of resolutions in this area, including Resolution 68/191, which set out recommendations to Member States and UN bodies, agencies and institutions on measures against gender-related killing of women and girls. In pursuance of this recommendation, an open-ended intergovernmental expert group meeting was convened to review promising practices and formulate a number of practical recommendations on ways and measures to improve the effectiveness of efforts to prevent and investigate gender-related killings. It is indicated that since 2019, UNODC has been implementing the Global Programme on Strengthening Crime Prevention and Criminal Justice Responses to Violence against Women, providing specific solutions that complement existing UN joint programmes and country projects. It is noted that the Committee on the Elimination of Discrimination against Women has played an important role in combating gender-based crimes. In particular, in its concluding observations on the periodic reports of States parties and in the context of relevant follow-up procedures, the Committee consistently condemns gender-based violence. In addition, the Committee provides clarification of the standards related to the elimination of such violence and the related obligations of States parties. The article also focuses on the work of the Special Rapporteur on violence against women and girls, its causes and consequences in this area.
