Компетенція Президента Республіки Польща щодо охорони її суверенітету, незалежності і територіальної цілісності

Abstract

Стаття присвячена дослідженню функцій Президента Республіки Польща. Констатується, що охорона суверенітету, незалежності і територіальної цілісності визнається польською конституційною доктриною однією із ключових функцій Президента Республіки Польща як глави держави. Підкреслюється, що компетенція Президента у сфері охорони суверенітету, незалежності та державної цілісності обумовлюється наявним у Польщі різновидом республіканської форми правління та, фактично, включає «традиційні» повноваження, які притаманні главам усіх держав, а також повноваження, властиві лише Республіці Польща. До традиційних повноважень Президента Республіки Польща як глави держави, пов’язаних із охороною суверенітету, незалежності та державної цілісності віднесено його повноваження, пов’язані із представництвом держави та міжнародними зносинами, а також керівництво Збройними Силами й повноваження у сфері оборони та внутрішньої безпеки. Зауважується, що у Республіці Польща результативність реалізації даних напрямів досягається за допомогою злагодженої роботи всіх органів державної влади, яку очолює глава держави. Водночас підкреслюється, що з огляду на те, що сфера охорони суверенітету, незалежності і територіальної цілісності Польської держави є предметом відання як глави держави, так і Уряду, то виникає необхідність чіткого розподілу повноважень указаних суб’єктів. Резюмується, що реалізація Президентом Республіки Польща функції щодо охорони суверенітету, незалежності і територіальної цілісності польської держави як в умовах збройного конфлікту, так і в мирний час безпосередньо нав’язують до дієвості системи органів державного управління, що представляють вертикаль безпосереднього примусу: армії, поліції та служб безпеки та одночасного використання інших конституційно-правових механізмів стримувань і противаг.

The article is devoted to the study of the functions of the President of the Republic of Poland. It is stated that the protection of sovereignty, independence and territorial integrity is recognized by the Polish constitutional doctrine as one of the key functions of the President of the Republic of Poland as the head of state.It is emphasized that the competence of the President in the field of protection of sovereignty, independence and state integrity is determined by the type of republican form of government available in Poland and, in fact, includes «traditional» powers that are inherent to the heads of all states, as well as powers that are unique to the Republic of Poland.The traditional powers of the President of the Republic of Poland as the head of state related to the protection of sovereignty, independence and state integrity include his powers related to the representation of the state and international relations, as well as the leadership of the Armed Forces and powers in the field of defense and internal security. It is noted that in the Republic of Poland, the effectiveness of the implementation of these directions is achieved with the help of the coordinated work of all state authorities, which is headed by the head of state. At the same time, it is emphasized that given the fact that the sphere of protection of the sovereignty, independence and territorial integrity of the Polish state is the subject of both the Head of State and the Government, there is a need for a clear distribution of the powers of the specified subjects.It is summarized that the implementation by the President of the Republic of Poland of the function of protecting the sovereignty, independence and territorial integrity of the Polish state both in conditions of armed conflict and in peacetime directly imposes on the effectiveness of the system of state administration bodies, which represent the vertical of direct coercion: the army, the police and security services and simultaneous use of other constitutional and legal mechanisms of checks and balances.
