Abstract

Аналізуються наукові підходи до розуміння природи правових позицій та визначається роль правових позицій у практичній діяльності Конституційного Суду України. Досліджується правова природа та обов’язковість для Конституційного Суду України правових позицій Європейського суду з прав людини. Ключові слова: Конституційний Суд України, правова позиція.

The article deals with the analysis of the scientifi c approaches to the nature of the legal position and defi nes the role of the legal position in the practice of the Constitutional Court of Ukraine.
