Класифікація правових імунітетів

Abstract

Стаття присвячена систематизації правових імунітетів. Надано класифікацію правових імунітетів: на підставі домінуючих ознак предмета правового регулювання; за суб’єктами, щодо яких імунітети застосовуються; на підставі природи та характеру функцій, які здійснюються правовими імунітетами; залежно від їх змісту; на підставі особливих ознак об’єктів, які забезпечують правові імунітети. Ключові слова: правові імунітети, класифікація, матеріально-правовий імунітет, процесуально-правовий імунітет, державний імунітет, міжнародний імунітет.

The article covers an issue of systematization of the legal immunities. Here was represented the classification of the legal immunities: under authority of prevailing features of the subject of the legal regulation; the subjects for which the immunities are applied; proceed from the nature and character of the functions that are inherent of the legal immunities; depending on their content; under authority of the special features of objects that protect the legal immunities . Key words: the legal immunities, the classification, the substantive immunity, procedural immunity, the sovereign immunity, the international immunity.
