Отримання згоди дитини при укладенні договору про патронат як умова договору

Abstract

Стаття 253 Сімейного кодексу України визначає передумову укладення договору про патронат –отримання згоди дитини, якщо дитина досягла такого віку, що може її висловити. Проте, законодавство не містить положення, яке вказує на вік, з досягненням якого дитина може висловлювати свою думку. Вважаємо за необхідне доповнити Сімейний кодекс України нормою, яка б визначала такий вік дитини, з досягненням якого дитина може ви- словлювати свою думку. Article 253 of Family Code of Ukraine determines the conditions for the conclusion ofagreement on patronage - obtaining the consent of the childifthe child reached the agein which can express their opinion.. But, legislation does not contain provisions specifying the age, with the achievement of whichthe child can express theiropinion. We consider it necessary to supplementthe Family Code of Ukraine witha principle that would identify a child's age, with the achievement of which the child can express their opinion.
