| dc.description | The article considers issues concerning the contractual regulation of mediation. The author analyzes the foreign legislation and makes the conclusion about the existence of two contractual stages of the establishment of mediation legal relationship. The first stage – conclusion of the agreement between the parties to appeal to mediation for resolving their dispute. The second stage – the contract between the parties of the dispute and the mediator for conducting the mediation. Author analyzes the draft law of Ukraine on mediation as compared with the corresponding legislative acts of the Republic of Belarus, Republic of Kazakhstan and the Russian Federation. | dc.description.abstract | У статті розглядаються питання, що стосуються договірного регулювання відносин медіації. На основі аналі- зу зарубіжного законодавства робиться висновок про існування двох договірних етапів встановлення медіаційних правовідносин – укладання першого договору між сторонами спору про звернення до медіації для вирішення спору і укладання другого договору між сторонами спору та медіатором про проведення медіації. Аналізується проект закону України про медіацію в порівнянні з відповідними законодавчими актами Республіки Білорусь, Республіки Казахстан, Російської Федерації.
