«ФІЗИЧНА КУЛЬТУРА» І «СПОРТ» ЯК БАЗОВІ КАТЕГОРІЇ ПРОФЕСІЙНОГО СПОРТУ: КОНСТИТУЦІЙНО-ПРАВОВИЙ АСПЕКТ

Abstract

Встановлено, що державна цільова соціальна програма розвитку фізичної культу- ри і спорту на період до 2020 року, затверджена Постановою Кабінету Міністрів Укра- їни від 1 березня 2017 р. № 115, не тільки визначає провідну роль фізичної культури і спорту в сучасному житті, але і вказує на необхідність удосконалення норматив- но-правової бази галузі суспільних відносин. Актуальною залишається і проблема сутності та змісту законодавчої дефініції професійного спорту, його співвідношен- ня з поняттями спорту, фізичної культури тощо. Аналіз чинної нормативно-правової бази у сфері професійного спорту свідчить про недостатню урегульованість пробле- ми правової термінології, відсутність загальнонаціональних стандартів, ігнорування елементарних правил формальної логіки в процесі побудови законодавчих дефініцій у галузі фізичної культури і спорту. Метою статті є огляд та конституційно-правовий аналіз базових для професійного спорту законодавчих понять «фізична культура» і «спорт». Досліджено нормативні визначення та проведено порівняльний аналіз цих термінів у юридичній науці, Законі України «Про фізичну культуру і спорт», Спор- тивній хартії Європи. Розглянуто питання класифікації спорту, вплив особливостей його окремих різновидів на проблему визначення цієї дефініції на законодавчому рівні. Доведено тісний взаємозв’язок понять «фізична культура», «спорт», «профе- сійний спорт»; при цьому професійний спорт є невіддільною частиною спорту вза- галі, а спорт своєю чергою є складником фізичної культури. Встановлено відсутність визначень понятійного апарату у cфері спортивної діяльності у текстах Конституції України та основних законів зарубіжних країн. Запропоновано авторське визначення поняття «спорт».

State targeted social program of the development of physical culture and sports for the period up to 2020, that was approved by the Resolution of the Cabinet of Ministers of Ukraine in March 1, 2017 No. 115, not only determines the leading role of physical culture and sport in modern life, but also indicates the need to improve the legal framework in this public relations [4]. The problem of the essence and content of the legislative definition of professional sport, its correlation with the concepts of sport, physical culture, etc., is still relevant. The analysis of the current legal framework in the field of professional sport shows the lack of regulation of the problem of legal terminology, the absence of national standards, the ignoring of elementary rules of formal logic in the process of constructing legislative definitions in the field of physical culture and sports. The purpose of the article is to review the constitutional and legal analysis of the legal concepts of “physical culture” and “sport”, which are basic for professional sports. The normative definitions were investigated and a comparative analysis of the terms was conducted in legal science, the Law of Ukraine “On Physical Culture and Sport”, in the Sport Charter of Europe. The article deals with the classification of sport, the influence of the features of its individual varieties on the problem of defining this definition at the legislative level. The close correlation between the concepts of “physical culture”, “sport”, “professional sport” has been proved; professional sport is an integral part of sport in general, and sport, in turn, is part of physical culture. The absence of definitions of the conceptual apparatus in the field of sports activities in the texts of the Constitution of Ukraine and the basic laws of foreign countries is installed. The author defines the concept of “sport”.
