КОНСТИТУЦІЙНІ ПРАВА І СВОБОДИ ОСІБ З ІНВАЛІДНІСТЮ: ПОНЯТТЯ, ЗМІСТ І ФОРМИ ЗАХИСТУ З БОКУ ОРГАНІВ ПУБЛІЧНОЇ ВЛАДИ

Abstract

У статті проаналізовано конституційні положення, в яких закріплено загальні та спеціальні права і свободи людей з інвалідністю. Обґрунтовується, що права зазначеної категорії осіб – закріплені в міжнародно-правових і національних за- конодавчих актах загальні та рівні для всіх членів суспільства положення щодо міри можливої поведінки. Визначено форми захисту прав і свобод осіб з інвалід- ністю, серед яких: соціальний захист, судовий захист, захист гідності та протидія дискримінації.

Constitutional positions in that common and special laws and freedoms of people are envisaged with disability are analyzed in the article. Grounded, that rights for the indicated category of persons – envisaged and national legislative acts general and even for all members societies of position in relation to the measure of possible behavior. The forms of protection of rights and freedoms of persons with disability, among that, are certain: social defense, judicial defense, defense of dignity and counteraction to discrimination.
