РЕАЛІЗАЦІЯ КОНСТИТУЦІЙНИХ ПРАВ ОСОБИ У СФЕРІ ПРАЦІ В УМОВАХ ТРУДОВОГО ДОГОВОРУ

Abstract

Стаття присвячена дослідженню умов трудового договору, за допомогою яких реалізуються основні права працівника у сфері трудових відносин. Умови трудового договору можна класифікувати за різними підставами, однак в основу будь-якої класифікації покладено принцип поєднання імперативного та диспозитивного правового регулювання праці. Метою статті є дослідження особливостей правового регулювання змісту трудового договору, в якому закріплюються основні конституційні права особи у сфері праці.

The article is devoted to the study of the terms of labor contract with a help of which the basic rights of the employee in the field of labor relations are realized. The terms of a labor contract can be classified on various grounds, but the basis of any classification is the principle of the combination of imperative and dispositive juridical regulation of labor. The purpose of the article is to study the peculiarities of the legal regulation of the content of the labor contract, which finds its consolidation of the basic constitutional rights of the individual in the field of labor.
