ПРАВО ГРОМАДЯНИНА УКРАЇНИ НА ЕФЕКТИВНИЙ ЗАСІБ ЗАХИСТУ ПОРУШЕНОГО ПРАВА

Abstract

Стаття присвячена застосуванню громадянином ефективного засобу захисту в разі порушення його конституційного права. Розкрито поняття ефективного способу захисту та використання практики Європейського суду з прав людини. Визначено, що запровадження в Україні конституційної скарги значно зменшить кількість звернень громадян до Європейського суду з прав людини.

The article is devoted to the application of a citizen of an effective remedy in case of violation of his constitutional rights. Opened notion of an effective method of protection and use of the European Court of Human Rights. It has been determined that the introduction in Ukraine of the constitutional complaint will significantly reduce the number of citizens in the European Court of Human Rights.
