ЗМІСТ ЗАЯВИ ПРО ВСТАНОВЛЕННЯ ФАКТУ, ЩО МАЄ ЮРИДИЧНЕ ЗНАЧЕННЯ

Abstract

Стаття присвячена аналізу особливостей змісту заяв про встановлення факту, що має юридичне значення. Автор наводить загальні та спеціальні вимоги, визначені Цивільним процесуальним кодексом України, до змісту заяви про встановлення факту, що має юридичне значення. Також зазначено підстави для залишення заяви про встановлення факту, що має юридичне значення, без руху, а також запропоновано спеціальний порядок звернення до суду в справах окремого провадження з вимогою про захист невизнаного права.

The article is devoted to the analysis of the peculiarities of the content of the statement for the establishing of a fact, which has a legal significance. The author defines the general and special requirements, which are defined by the CPC of Ukraine to the content of the statement on the establishing of a fact of legal significance. The article also defines the grounds for abandoning the statement for the establishment of a fact of legal significance without movement, as well as proposes a special procedure for applying to a court in cases of separate proceedings with a claim for the protection of an unrecognized right.
