Проблеми визначення особливостей адміністративно-територіального устрою Римської держави

Abstract

Стаття присвячена висвітленню основних проблемних характеристик, які властиві адміністративно-територі- альному устрою Римської держави в процесі її формування в часі та постійної зміни територіальних кордонів. Проаналізовано основні принципи, що вплинули на формування особливостей її адміністративно-територіальної структури та механізмів державного регулювання та, як наслідок своєї складності та неоднозначності, унемож- ливили створення уніфікованого підходу для визначення єдиних стандартів і дефініцій цих теоретико-правових категорій. Проблемним нюансом сучасних досліджень є те, що, по суті, здебільшого відбувається екстраполяція принципів державно-територіального управління центральних моделей на периферію або ж беруться за зразок взаємини Риму з його найбільш відомими та дослідженими федератами. Автор акцентує увагу на такі риси ад- міністративно-територіального устрою Римської держави, як динамічність територіального охоплення у вигляді постійного коливання ліній кордонів; індивідуальність управлінського та правоустановчого підходів із боку вищих і центральних римських державних структур до територіальних громад, поселень та їхніх органів; скомбінованість полісної та класичної територіальної моделі організації суспільства та органів влади на всій території Римської держави; анклавність адміністративно-територіальних одиниць і суб’єктів римської федерації з погляду типізації їхнього управління; відсутність стабільності умов договорів приєднання племен і територій, які визначають право- вий статус цих суб’єктів у складі Римської держави. Величезна складність цих ознак державно-територіальної ор- ганізації Риму вимагає від дослідників історії його правового та державного розвитку застосування методологічних застережень під час аналізу територіального устрою та функціонування римських управлінських інституцій. Article studies the main problematic features of the Roman state’s administrative and territorial structure evolved during the constant border changes. The main principles of forming its administrative and territorial structure together with state bodies’ regulatory framework are analyzed. The great complications and ambiguities of this institute have made impossible to form a single, unified approach in using common legal theoretical standards, categories and definitions towards it. The problematic nuance of the modern researches is that, essentially, they tend to extrapolate the central state territorial governing models to the periphery. The relations of Rome with the most known or examined foederati are usually taken as a generally applicable standard, but this approach twist and simplifies the real legal situation. The author of the article makes an accent on such features of the Roman state’ administrative and territorial structure as: permanently moving borders lines; individuality of the governing and law-establishing approach from the high and central Roman governmental bodies to the territorial communities, settlements and its local governance; combining of the polis and classical territory models of the society organization and governing bodies all over the Roman state; enclave governing’ type of the Roman federation subjects and the Roman administrative entities; non-stable terms and conditions of the communities and territories adhesion treaties, which established those subjects’ legal status within the Roman state. Significant complexity of the abovementioned features of the administrative and territorial structure of the Roman state requires being methodologically careful while studying the evolution of the Roman territorial organization and the functioning of its governing institutions.
