Поняття «легалізація профспілок» та «реєстрація профспілок»: теоретико-правові проблеми визначення і співвідношення

Abstract

Стаття присвячена дослідженню проблем законодавчого регулювання таких понять, як «легалізація профспілок» та «реєстрація профспілок». Констатується, що у вітчизняній науковій літературі зазначені поняття не завжди належним чином розрізняються, що при- зводить до певної термінологічної невизначеності та плутанини щодо моменту виникнення конституційної правосуб’єктності профспілок. Наводиться визначення поняття «легалізація профспілок» та поняття «реєстрація профспілок», окреслюються проблемні аспекти їх співвідношення. Ключові слова: профспілки, право на об’єднання в профспілки, статус профспілок, діяльність профспілок, створення профспілок, легалізація профспілок, реєстрація профспілок.

The article explores issues connected with the legislative regulation of such notions as “legitimation of trade unions” and “registration of trade unions”. It is stated that in home scholarly literature these notions are not differentiated in the proper way, which results in terminological ambiguity and confusion related to obtaining the constitutional legal personality by trade unions. The article contains the definition of the notion “legitimation of trade unions” and the notion “registration of trade unions”. It also outlines the issues connected with the correlation of these notions. Key words: trade unions, right to form and join trade unions, trade union status, activities of trade unions, formation of trade unions, legitimation of trade unions, registration of trade unions.
