Новели законодавства України у сфері охорони прав на сорти рослин у контексті європейської інтеграції України

Abstract

У статті аналізуються останні зміни у чинному законодавстві України про охорону прав на сорти рослин. Окрема увага приділяється розробці науково обґрунтованих рекомендацій щодо удосконалення нормативно-правової бази у сфері інтелектуальної власності на сорти рослин. Зазначене завдання вирішується крізь призму розробки пропозицій щодо удосконалення правових та організаційних засад функціонування і розвитку сфери охорони прав на сорти рослин. Ключові слова: сорт, сорт рослин, новий сорт рослин, інтелектуальна власність, правове регулювання, селекційна діяльність.

In the article the last updates are analysed in the current legislation of Ukraine of rights on plant variety. Most attention is spared to development of scientifically reasonable recommendations in relation to the improvement of normatively-legal base in the field of intellectual property on the plant variety. The marked task decides through the prism of development of suggestions in relation to the improvement of legal and organizational principles of functioning and development of sphere of guard of rights on the plant variety.
