Фінансово-правові процедури як складники фінансового процесу: теоретико-правовий аспект

Abstract

Статтю присвячено теоретико-правовому аналізу понять «юридичний процес», «фінансовий процес» та «фінансові процедури», визначенню їхніх специфічних ознак. Автор зіставляє ці поняття та робить висновок про те, що фінансовий процес – це особливий вид юридичного процесу, який складається зі стадій, які чітко визначені в законодавстві, розташовані в логічні послідовності і мають замкне- ний цикл. Кожна зі стадій містить фінансово-правові процедури, проведення яких передбачено в законодавстві. Ключові слова: юридичний процес, фінансовий процес, фінансово-правові процедури, стадії фінансового процесу.

The article is devoted to theoretical and legal analysis of the concepts of “legal process”, “financial process” and “financial and legal procedures” and definition of their specific features. The author compares these concepts and concludes that the financial process is a special type of legal process, which consists of stages, which are clearly defined in the law and are arranged in a certain logical sequence and have a closed loop. Each of the stages contains financial and legal procedures for holding them in the legislation.
