Наукові підходи до розуміння сутності зловживання правом

Abstract

В статті аналізуються наукові підходи до розуміння сутності зловживання правом як на загальнотеоретичному рівні, так і в галузі кримінального процесу. Звертається увага на наявність дискусійних питань, які є у наукових підходах, що досліджуються, обґрунтовується власне розуміння проблеми зловживання правом у кримінальному процесі. Також зроблені відповідні висновки щодо даної проблематики.

Іn the article аrе analyzed scientific approaches to understanding of the essence of abuse of the right on the general theoretical level as well as in the branch of the criminal process. Attention is drawn to availability of debatable questions which аrе in scientific approaches in question, is given а personal interpretation of the problem of abuse of the right in the criminal process. Also it was made appropriate conclusions to this issue.
