Евтаназія в Україні: питання реалізації конституційного права людини

Abstract

В статті здійснено характеристику приписів Конституції України щодо життя людини як найвищої соціальної цінності та права на життя як найважливішого серед особистих немайнових прав, зумовленого самою природою людини. Проаналізовано парадоксальну ситуацію: цінність життя людини, як особистого немайнового блага зростає, що призвело до міжнародного та національного правового закріплення норм, які забезпечують всебічний захист життя, в той самий час коли життя окремої людини день за днем знецінюється. Серед одного зі свідчень цьому в статті наведено всесвітню увагу до обговорення проблеми права людини на смерть та підвищений інтерес до проблеми евтаназії.

In accordance with the Constitution of Ukraine, the article defines that human life in Ukraine is recognized as the highest social value, and the right to life is the most important among personal non-property rights, which is due to human nature and is at the top of social values. At the same time, today we can observe a rather paradoxical picture: the value of human life as a personal intangible good is growing, which has led to international and national legal consolidation of norms that provide comprehensive protection of life, whilst the life of the individual depreciates day by day. One clear indication of this is the worldwide boom in the discussion of the human right to die and the growing interest in the problem of euthanasia.
