Механізм запобігання злочинності в місцях позбавлення волі

Abstract

У статті досліджено основні засади запобігання злочинності в місцях позбавлення волі. Визначено, що пенітенціарні засади та механізм запобігання кримінальним правопорушенням в місцях несвободи залишаються першочерговими завданням Державної політики у сфері виконання кримінальних покарань. Саме вони забезпечують порядок і умови виконання і відбування покарань в місцях позбавлення волі в Україні та гарантують безпеку суспільства. Акцентовано увага на те, що установи виконання покарань повинні повертати в суспільство повноцінну особистість. Визначено, що запобігання злочинності в місцях позбавлення волі, як частина всієї злочинності, повинно здійснюватися на трьох рівнях: загально-соціальному, спеціально-кримінологічному та індивідуальному.Загальносоціальне запобігання злочинності в місцях позбавлення волі - це, насамперед, комплекс перспективних соціально-економічних, організаційно-управлінських, ідеологічних, культурно-виховних та інших заходів, спрямованих на вирішення гострих соціальних проблем і негараздів у країні. Окрім цього органи й установи виконання покарань можуть застосовувати такі спеціальні заходи кримінологічної профілактики, як відвернення і припинення злочинів. Запобігання й припинення злочинів переносяться на ті стадії розвитку злочинної поведінки, які характеризуються або виникненням наміру вчинити злочин, або коли поведінка деяких осіб здатна його викликати, або коли злочин уже почав фактично вчинюватися. Запобіжна діяльність у місцях позбавлення волі може спиратись на методи ней-тралізації криміногенних явищ, деалкоголізації й девіктимізації, руйнування кримінальної субкультури, кримінально-правового утримання від учинення злочинів, медико-реабілітаційного характеру. Обґрунтовано, що для рецидиву злочинів має місце факт продовження перебування особи у криміногенному середовищі або повернення її у нього після відбуття покарання чи умовно-дострокового звільнення. Встановлено, що запобігання злочинності в місцях позбавлення волі потребує вдосконалення та врегулювання його механізму. Запропоновано систему заходів, які б максимально запобігали можливості вчинення злочинів у місцях позбавлення волі. Та констатовано, що для підвищення цієї діяльності перш за все слід усунути організаційно-управлінські, контрольно-наглядові, інформаційні, оперативно-розшукові та інші детермінанти, які сприяють вчиненню кримінальних правопорушень в місцях позбавлення волі.

The article examines the basic principles of crime prevention in places of deprivation of liberty. It was determined that penitentiary principles and the mechanism for preventing criminal offenses in places of detention remain the primary task of the State Policy in the field of execution of criminal punishments. It is they who ensure the order and conditions of execution and serving of sentences in places of deprivation of liberty in Ukraine and guarantee the safety of society. Emphasis is placed on the fact that penal institutions must return a full-fledged individual to society. It was determined that prevention of crime in places of deprivation of liberty, as part of all crime, should be carried out at three levels: general social, special criminological and individual.General social prevention of crime in places of deprivation of liberty is, first of all, a complex of promising socio-economic, organizational-management, ideological, cultural-educational and other measures aimed at solving acute social problems and troubles in the country. In addition, bodies and institutions for the execution of punishments can apply such special measures of criminological prevention as prevention and cessation of crimes. Prevention and termination of crimes are transferred to those stages of the development of criminal behavior, which are characterized either by the emergence of the intention to commit a crime, or when the behavior of some persons is capable of causing it, or when the crime has already begun to actually be committed. Preventive activities in places of deprivation of liberty can be based on methods of neutralization of criminogenic phenomena, dealcoholization and devictimization, destruction of the criminal subculture, criminal law abstinence from committing crimes, medical rehabilitation.It is substantiated that the fact of a person’s continued stay in a criminogenic environment or his return to it after serving a sentence or parole is necessary for recidivism.It was established that the prevention of crime in places of deprivation of liberty requires improvement and regulation of its mechanism. A system of measures was proposed that would maximally prevent the possibility of committing crimes in places of deprivation of liberty. However, it has been established that in order to increase this activity, first of all, it is necessary to eliminate organizational-management, control-supervisory, informational, operative-search and other determinants that contribute to the commission of criminal offenses in places of deprivation of liberty.
