Нові виклики четвертого покоління прав людини: право на одностатеві шлюби

Abstract

Констатовано, що праворозуміння, правосвідомість та правова культура зазнають змін на кожному етапі розвитку суспільства, однак безліч каталізаторів пришвидшують або тим чи іншим чином впливають на перебіг процесу модернізації підходів до розуміння і тлумачення правової норми.У статті зазначається, що четверте покоління прав людини розглядають, як правову відповідь на проблеми XXI століття, коли мова піде про виживання людства як біологічного виду, про збереження цивілізації, подальшій космічній соціалізації людини. Автор наголошує, що під впливом нових суспільних, державних, соціальних, культурних та політичних викликів формується нове бачення реалізації вищезгаданих прав у законодавствах країн. При цьому суспільство чітко заявляє про своє усвідомлене бажання мати повний спектр засобів і інструментів процедурної реалізації прав четвертого покоління.Автор привертає увагу саме до одного з найпроблемніших та найактуальніших прав – на одностатеві шлюби. Так, досліджено зарубіжний досвід країн, які поділилися на дві групи: ті, які легалізувати право на одностатеві шлюби та ті, які виступають проти такої легалізації.У статті також розглядається національний досвід пов’язаний із одностатевими шлюбами: законодавче закріплення шлюбу, сім’ї. Окрім цього, згадано про громадські інструменти впливу такі, як петиції, за допомогою яких питання легалізації одностатевих шлюбів в Україні призвело до появи законопроекту про цивільні партнерства. Автор наводить актуальну практику Європейського суду з прав людини. Справи Macate v. Lithuania, Fedotova and Others v. Russia, Maymulakhin and Markiv v. Ukraine доводять, що коли мова йде про визнання одностатевих пар, шлюбів на державному рівні, то заборони у такому визнанні або відсутність будь-якого регулювання, є проявами порушення права на повагу до приватного та сімейного життя, свободу вираження поглядів та заборони дискримінації. Узагальнено, що сьогодні право четвертого покоління прав людини – на одностатевий шлюб – переживає новий етап викликів, які постають при його реалізації, адже набирає обертів тенденція легалізації інституту, оскільки є запит і потреба громадян.

It was stated that legal understanding, legal awareness and legal culture undergo changes at each stage of the development of society, however, many catalysts speed up or in one way or another affect the course of the process of modernization of approaches to the understanding and interpretation of the legal norm.The article notes that the fourth generation of human rights is considered as a legal answer to the problems of the 21st century, when it comes to the survival of humanity as a biological species, the preservation of civilization, and the further cosmic socialization of man.The author emphasizes that under the influence of new public, state, social, cultural and political challenges, a new vision of the implementation of the above-mentioned rights in the legislation of countries is being formed. At the same time, the society clearly declares its conscious desire to have a full range of means and tools for the procedural implementation of the rights of the fourth generation.The author focuses on the one of the most problematic and relevant rights – fsame-sex marriage. Thus, the foreign experience of countries that were divided into two groups was studied: those that legalized the right to same-sex marriage and those that opposed such legalization.The article also deals with the national experience related to same-sex marriages: legal consolidation of marriage, family. In addition, public instruments of influence such as petitions were mentioned, with the help of which the legalization of same-sex marriages in Ukraine led to the appearance of a draft law on civil partnerships The author adduces the actual practice of the European Court of Human Rights. The cases of Macate v. Lithuania, Fedotova and Others v. Russia, Maymulakhin and Markiv v. Ukraine prove that when it comes to the recognition of same-sex couples and marriages at the state level, prohibitions on such recognition or lack of any regulation are manifestations of violation of the right to respect for private and family life, freedom of expression and prohibition of discrimination.It is generalized that today the right of the fourth generation of human rights - same-sex marriage - is experiencing a new stage of challenges that arise in its implementation, because the trend of legalizing the institution is gaining momentum, as there is a demand and need of citizens.
