Дослідження взаємодії приватних охоронних структур зі сферою публічного адміністрування в Україні

Abstract

У статті сформовано принципи та умови взаємодії публічного адміністрування зі сферою приватних охоронних послуг в Україні. Розкрито теоретичні засади публічного адміністрування у сфері охоронної діяльності, зокрема визначено поняття публічного адміністрування та основні підходи до його формування. Охарактеризовано законодавчо-нормативне регулювання публічного адміністрування у сфері охоронних послуг. Проведено аналіз взаємодії публічного адміністрування з агентствами охоронної безпеки. Охарактеризовано сучасний ринок приватних охоронних послуг України. Проаналізовано динаміку розвитку цього ринку протягом 2011–2019 рр. Окреслено основні чинники зростання попиту на охоронні послуги в Україні. Досліджено регіональний аспект розвитку вітчизняного ринку охоронних послуг. Проаналізовано монопольне становище поліції охорони на цьому ринку. Визначено основних гравців ринку охоронних послуг в Україні. Виділено основні причини проблематики взаємодії приватних охоронних агентств та правоохоронних органів, а також шляхи їх вирішення.

The article deals with the problem of relations between society and business in the conditions of separation of their interests, which requires new approaches to public administration in the process of development of modern society. The realization of public administration in the modern dynamic society is analyzed, which is regulated by legislative acts and normative documents that ensure effective interaction of state bodies with market actors. The article outlines the principles and conditions of interaction of public administration with the sphere of private security services in Ukraine. The theoretical foundations of public administration in the field of security are revealed, in particular the concepts and basic approaches to the formation of public administration are defined. The legislative and regulatory regulation of public administration in the field of security services is characterized. The Law of Ukraine “On security activities” is considered in detail. The analysis of interaction of public administration with security agencies is conducted. The modern market of private security services of Ukraine is characterized. The dynamics of development of this market during 2011–2019 is analyzed. The main factors of increasing demand for security services in Ukraine are outlined. The regional aspect of the development of the domestic market of security services is investigated. The monopoly position of the police in this market and the reasons for the monopolization are analyzed. The major players of the security services market in Ukraine as of the 4th quarter of 2019 have been identified. Procurement by local government of security services through ProZorro (transparent) – the official portal of public procurement information in Ukraine is considered. The main causes of the problem of interaction of private security agencies and law enforcement agencies are identified, which include: imperfection of development of theoretical bases of interaction between private and state security structures; specifics of the organization of law enforcement activities; lack of adequate training and qualifications of employees of private security agencies. The main ways of solving the problems of interaction of private security agencies and law enforcement agencies to which they include: improvement of the existing legislative base and by-laws by amending the existing and adopting new Laws of Ukraine; improving the licensing procedure for private security structures in accordance with the Law of Ukraine “On Licensing of Economic Activities” by restricting direct contacts between the licensing entity and the licensing authority; improving the conditions for conducting tenders by admission of private security firms to the monopoly sector of the market.
