Дослідження бінарних опозицій у праві як розширення предметного поля вітчизняної філософії права

Abstract

Стаття присвячена визначенню нових підходів у сучасному вітчизняному правознавстві, обумовлених соціо- культурною та методологічною ситуаціями. Це дослідження повною мірою відповідає особливостям філософсько-правового знання, яке робить можливою реалізацію взаємних зв’язків філософії, філософської антропології, семіотики, соціальної філософії. Особлива увага фокусується на проблемі бінарних опозицій як конструктивних елементів права і правової дійсності. Ключові слова: «наукова» глобалізація, бінарні опозиції, консерватизм і новаторство у праві, правова традиція, культура.

The article is devoted to the identification of new approaches to the modern domestic jurisprudence, brought to life by contemporary socio-cultural and methodological situations. This study is fully correspond to the peculiarities of philosophical and legal knowledge, which makes it possible to realize the mutual connection of philosophy, philosophical anthropology, semiotics, social philosophy. Special attention is paid to the problem of binary oppositions yak structural elements of law and legal reality. Key words: «scientific» globalization, binary oppositions, conservatism and innovation in the law, the legal tradition and culture.
