Український парламент в умовах воєнного стану: особливості функціонування

Abstract

У статті досліджено питання функціонування українського парламенту й специфіки його діяльності в умовах воєнного стану та подальших напрямів покращення. Проаналізовано законодавчі актів, що визначають порядок роботи парламенту в обставинах надзвичайного характеру. Закцентувано увагу на адаптації роботи та особливостях виконання законотворчої функції в умовах режиму воєнного стану. Визначено основні напрямами роботи порядку денного народних депутатів в умовах військової агресії, що фокусувалися на безпеці й обороні, охороні правопорядку, фінансових ресурсах, соціальних питання, підтримці економіки держави. Результатом реалізації законодавчої функції стало ухвалення парламентом рекордної кількості важливих законів у режимі тривалого пленарного засідання, однак за всіма показниками значним зменшенням часу на опрацювання та проходження законопроєктів. Доведено зростання пропускої здатності парламенту після введення воєнного стану. Пропоновано впровадження у роботу засідань порядків денних парламентарів меншу кількість законопроєктів щодо розгляду, що сприятиме більш ефективній якості. Аналіз засвідчив про тенденцію прийнятих законів на початковій стадії повномасштабного вторгнення, що в переважній мірі стосувалися внесення змін до інших законів. Акцентовано увагу на обмеженні відкритості парламентської роботи з введенням воєнного стану через безпекові питання, а також про подальше посилення комунікаційної спроможності. Сфокусовано увагу, що Регламентом Верховної Ради України не встановлено особливих чи прискорених процедур законодавчого процесу під час воєнного стану (застосовується єдиний законодавчий процес у мирний та воєнний період); не визначено спеціальних механізмів для засідань, що відбуваються у різних інституційних формах та функціях. Підкреслено про важливість продовження парламентської реформи, визначено її ключові проблеми та подальші кроки впровадження. Запропоновано подальші напрями покращення функціонування українського парламенту в умовах воєнного стану.

The article examines the issue of the functioning of the Ukrainian parliament and the specifics of its activity in the conditions of martial law and further directions for improvement. Legislative acts defining the procedure for the work of the parliament in circumstances of an extraordinary nature have been analyzed. Attention is focused on the adaptation of the work and the peculiarities of the performance of the law-making function in the conditions of the martial law regime. The main directions of work of the agenda of people's deputies in the conditions of military aggression, focusing on security and defense, law enforcement, financial resources, social issues, and support of the state's economy, were determined. The result of the implementation of the legislative function was the adoption by the parliament of a record number of important laws in the mode of a long plenary session, however, by all indicators, a significant reduction in the time for processing and passage of draft laws. It has been proven that the parliament's bandwidth increased after the introduction of martial law. It is proposed to introduce a smaller number of draft laws into the work of parliamentarians' agendas, which will contribute to more effective quality. The analysis showed a tendency of the adopted laws in the initial stage of the full-scale invasion, which were mostly related to the introduction of changes to other laws. Attention was focused on limiting the openness of parliamentary work with the introduction of martial law due to security issues, as well as on further strengthening of communication capacity. Attention is focused on the fact that the Regulations of the Verkhovna Rada of Ukraine do not establish special or accelerated procedures for the legislative process during martial law (a single legislative process is applied during peacetime and wartime); special mechanisms for meetings held in different institutional forms and functions are not defined. The importance of continuing the parliamentary reform was emphasized, its key problems and further steps of implementation were identified. Further directions for improving the functioning of the Ukrainian parliament in the conditions of martial law are proposed.
