| Abstract: | Стаття присвячена дослідженню особливостей застосування правового звичаю у судовій практиці. Особливу увагу приділено питанням виявлення звичаю в процесі розгляду справи та вимогам щодо змісту поняття «звичай». Запропоновано розширити сферу дії звичаїв при регулюванні сімейних відносин. Article deals with investigation of peculiarities of legal custom in judicial practice. Particular attention is paid on identification of the custom in the course of the proceedings and requirements for the meaning of definition of «custom». It is proposed to extend the scope of application of customs for the regulation of family relations. |
