Філософсько-правовий аналіз свободи волі людини

Abstract

У статті здійснено філософсько-правовий аналіз свободи волі людини. З’ясовано, що свободу волі у філософії права визначають два напрями: детермінізм та індетермінізм. Доведено, що нинішня концептуалізація дослідження свободи волі людини формувалася виключно під впливом узагальненого детермінізму. Загалом свобода волі є структурною складовою особистості, зокрема її творчої та діяльнісної активності. Це не стільки здатність приймати конкретні рішення, скільки вміння її реалізовувати. Безумовно, ця здатність до реалізації залежить, попри вплив з боку соціального середовища, від рівня інтелектуальної та правової культури. Своєю чергою, реалізація триває лише за умови збігу передбачуваних цілей із ключовими суспільно значущими тенденціями розвитку держави соціально-демократичного спрямування. The article is devoted to philosophical and legal analysis of the free will of man. It was found, that free will in philosophy of law define two areas: determinism and indeterminism. It is proved, that the current conceptualization of the study of human free will was formed exclusively under the influence of the generalized determinism. In general, freedom of will is a structural component of the individual, most likely – its creative and active activities. It is not so much the ability to take concrete decisions as the ability to implement it. Of course, this depends on the ability to implement, despite the impact from the social environment, the level of intellectual and legal culture. In turn, the implementation is carried out only when the coincidence of the anticipated targets with key socio-significant trends of the state of social-democratic orientation.
