Проблемні питання визначення поняття «адвокатська таємниця»

Abstract

Стаття розкриває основні аспекти поняття адвокатської таємниці, його зміст та обсяг, джерела й суб’єкти. У роботі розглядаються проблеми формування поняття «адвокатська таємниця» як правової категорії, а також як інституту права. Було проаналізовано основні наукові праці щодо визначення обсягу та змісту поняття адвокатської таємниці. Визначено основні джерела й суб’єкти, а також запропоновано власне бачення класифікації суб’єктів адвокатської таємниці. Автор намагається вивести найбільш загальне й універсальне поняття адвокатської таємниці, яке охопить всі ознаки такого інституту. Автором розглянуто питання моменту початку захисту адвокатської таємниці. У статті було запропоновано власне визначення поняття «адвокатська таємниця», яке вмістило в себе всі найбільш важливі, на думку автора, ознаки такого поняття.

The article focuses on the main aspects of the concept of confidentiality, its content and scope, sources and subjects. The paper addresses the problem of concept formation “of confidentiality” as a legal category, as well as the institution of law. It analyzes the main research portfolio to determine the scope and content of the concept of confidentiality. The author of the article raised the question of criteria for classifying information to one that can defend law secret and highly controversial question of keeping secret the person who asked the lawyer, whether the principal is or a third party. The author tries to derive the most general and universal concepts of confidentiality, which will cover all the features of this institute. The author considered the beginning of the protection of confidentiality. The article was actually proposed definition of “lawyer confidentiality” which embraces the all the most important features of such a concept.
