Abstract

Стаття присвячена розкриттю місця та ролі юридичних фактів у системі юридичної конфліктології. Юридичний факт є необхідною передумовою як виникнення конфліктної юридичної ситуації, так і безпосереднього виникнення конфліктних правовідносин. Добре продуманий комплекс юридичних фактів за рахунок надання юридичного значення тим чи іншим життєвим обставинам значним чином впливає на динаміку розвитку юридичних конфліктів, направляє їх у потрібне русло, сприяє їх ефективному вирішенню та попередженню.

The article is devoted to the place and role of legal facts in the system of legal conflictology. Legal fact is a necessary precondition for arising the conflict legal situation and also the direct arising conflict legal relationships. Well thought complex of legal facts by providing the legal significance one way or another life circumstances significantly affect on the dynamics of development of legal conflicts, direct them in the right direction, and promote to their effective solution and prevention.

Legal conflictology studies those conflicts which are characterized by the legal aspect, legal position and are connected with real legal relationships that are generated by legal facts. Legal fact is a necessary precondition for arising the conflict legal situation and also the direct arising conflict legal relationships. This bears witness that the legal facts serve as evidence for arising, change and suspension of legal relationships. In the system of legal conflictology legal facts have peculiar character, which can be summarized in three main principles: Firstly, the legal fact is the evidence for conflict arising; In the dynamics of legal conflict the legal fact is a necessary precondition for arising the conflict legal situation and also the direct arising conflict legal relationships. Secondly, legal facts are the single evidence for proof or disproof of certain conflict life circumstances. The legal conflict underlies the proof and is the only opportunity that is offered to the person for ascertainment of fact of law enforcement organ. Thirdly, on the basis of legal facts is exercised the prevention and solution of legal conflicts (law enforcement activity). Within the legal conflictology the given aspect is viewed as a fundamental means for legal impact on social conflicts. Based on the given information, legal conflicts are a kind of specific legal relationships, we can confirm that without legal facts it is impossible neither arising, nor change, nor suspension of any legal conflict. Only with the help of controversial statements about legal facts and legal decisions based on legal grounds, one of these statements as truth, it is possible to resolve and prevent conflict relationships, their transformation in unequivocal legal relationships.
