Режим окремого проживання подружжя за сімейним законодавством України та Польщі: порівняльно-правові аспекти

Abstract

Стаття присвячена порівняльному аспекту з’ясування сутності режиму окремого проживання подружжя згідно національного законодавства та сімейного законодавства Польщі. Проаналізовано підходи вчених щодо визначення спільних та відмінних ознак впровадження й вироблення механізму реалізації сепарації в Україні та Польщі. Ключові слова: сім’я, подружжя, польське сімейне право, розірвання шлюбу, сепарація, режим окремого проживання подружжя.

The article deals with the comparative aspect of the essence clarification of the spouse’s separation regime according to national laws and family law in Poland. The scientists’ approaches of identifying of common and distinctive features of the implementation and development of separation mechanism in Poland and Ukraine are analyzed. The author focuses on the liability of application of forced separation by the court as a means of family protection against hasty and unreasonable decisions in order to promote the defense and realization of family rights and legitimate interests.
