Поняття шлюбу

Abstract

У статті проаналізовано підходи до розуміння поняття «шлюб», розкрито зміст категорій, які використовуються для його визначення. Піддано критиці визначення шлюбу як союзу пожиттєвого, як союзу з метою народження та виховання дітей, як союзу рівноправних чоловіка та жінки, як сімейного союзу. Автором співставлено категорії «шлюб як союз чоловіка та жінки» та «шлюб як договір між чоловіком та жінкою». За результатами дослідження автором запропоновано відмінне від законодавчого визначення поняття шлюбу та визначено його ознаки. Ключеві слова: шлюб, добровільність шлюбу, шлюб як союз, реєстрація шлюбу, позитивні умови вступу в шлюб, ознаки шлюбу.

The article analyzes the approach to understanding of the concept of «marriage», presents the content of the categories that are used for its definition. It is criticized the definition of marriage as a life-long union, as union on with the aim of giving birth to children and bringing them up, as a union of equal in rights a man and a woman, as a family union. The author compares categories of «marriage as a union of a man and a woman» and «marriage as a contract between a man and a woman». According to the results of the study the author proposes different from the legislative definition of the concept of marriage and defines its signs.
