Abstract: | У статті досліджено проблему класифікації договору найму за римським правом та проаналізовано основні підходи до визначення місця locatio-conductio rei, locatio-conductio operis та locatio-conductio operarum в структурі locatio-conductio. Зосереджено увагу
на позові як основному критерії визначення поняття locatio-conductio.

This article explores the problem of classification of the hiring contract in Roman law. The main approaches to the determination of the peace of locatio-conductio rei, locatio-conductio operis and locatio-conductio operarum in the structure of locatio-conductio are analyzed. The attention is payed to the lawsuit as the main criteria of the definition of locatio-conductio.
