Повноваження та відповідальність опікуна за римським приватним правом

Abstract

Стаття присвячена з’ясуванню поняття, змісту і характерних ознак інституту опіки (tutela) за римським приватним правом та цивільним законодавством України, визначенню характеру та ступеню рецепції повноважень та відповідальності опікунів за римським приватним правом, а також формулюванню пропозицій щодо вдосконалення правового регулювання інституту опіки за чинним ЦК України у сфері повноважень та відповідальності опікунів. Ключові слова: опіка за римським приватним правм, опікун, права, обов’язки, відповідальність, рецепція.

The paper studies the concepts, content, and characteristic features of the institute of guardianship (tutela) of Roman private law and civil legislation of Ukraine, the nature and extent of the reception of authority and responsibility for the guardians of Roman private law, as well as the formulation of proposals for the improvement of the legal regulation of the institute of guardianship for the current CC Ukraine in the sphere of authority and responsibility of trustees. Key words: care under the Roman private law, the trustee, the rights, duties, responsibilities, reception.
